CLIENT SERVICE AGREEMENT

Defyn Yourself LLC

This Agreement is between Defyn Yourself LLC, an Ohio limited liability company ("Defyn Yourself," "we," or "us"), and the individual accepting these terms ("Client" or "you"). By booking a session, purchasing a package, or starting a monthly service, you agree to these terms.

1. Services

Defyn Yourself provides personal training, partner training, individualized exercise programming, and general nutrition coaching. The specific services you purchase are described at the time of booking or purchase.

Scope limitation. Defyn Yourself provides general, non-medical fitness and nutrition guidance only. We do not provide medical advice, diagnosis, treatment, physical therapy, rehabilitation, or medical nutrition therapy, and we do not hold ourselves out as practicing dietetics or any other licensed profession. Nothing provided to you is a substitute for care from your physician or another licensed healthcare provider.

2. Assessment required

Every new client must complete a 60-minute initial assessment, including a health history and pre-exercise screening, before any training session. The assessment fee is $50 and is credited in full toward your first package purchase.

We may decline to provide services, or may require written clearance from your physician, based on information disclosed during screening.

3. Rates and payment

Current rates are published at defynyourself.com/services and are incorporated into this Agreement. Rates may change on 30 days' notice; any package or subscription already purchased is honored at the rate in effect when you bought it.

  • Single sessions are paid at the time of booking.

  • Packages are paid in full at purchase.

  • Monthly services are billed in advance on a recurring basis (see Section 6).

Payments are processed by Stripe. We do not store your card details.

4. Session packages

Session packages expire as follows, measured from the date of purchase:

Package Expires: 4 sessions 30 days; 8 sessions 60 days; 14 sessions 90 days

Unused sessions expire and are not refundable or transferable except as provided in Section 8. Packages apply only to the session length purchased and may not be exchanged for a different length.

5. Scheduling, cancellation, and no-shows

24-hour notice is required to cancel or reschedule a session.

  • Cancelled or rescheduled with more than 24 hours' notice: no charge; a package session is returned to your balance.

  • Cancelled with less than 24 hours' notice, or missed entirely: the session is charged in full, or deducted from your package balance.

  • If you arrive late, your session ends at its scheduled time and is charged in full.

Cancellations must be made through your appointment confirmation link or by calling or texting (440)629-8094. Email is not a valid method of cancellation, because it may not be seen in time.

We may waive a late-cancellation charge at our discretion in a genuine emergency. Doing so once does not waive the policy.

If we cancel a session, it is rescheduled at no charge or returned to your package balance.

6. Monthly services and automatic renewal

Nutrition coaching and remote programming are billed monthly in advance and automatically renew each month until you cancel.

  • Your first charge occurs when you subscribe. Each subsequent charge occurs on the same day of each following month.

  • You may cancel at any time before your next billing date, effective at the end of the period you have already paid for. You keep access through that period.

  • Cancel yourself through the billing portal link in your welcome email, or by emailing support@defynyourself.com.

  • We do not refund partial months.

7. Your responsibilities

You agree to:

  • Disclose all relevant health conditions, injuries, medications, and limitations, and to update us promptly if they change

  • Follow instructions during sessions and stop immediately if you experience pain, dizziness, or distress

  • Train within your own limits and use equipment as directed

  • Arrive in appropriate clothing and footwear

8. Refunds

  • Unused packages are refundable within 14 days of purchase, less the value of any sessions already used at the single-session rate.

  • Monthly services are not refundable for the current period; cancel before the next billing date to avoid further charges.

  • Completed sessions are not refundable.

  • If we are unable to continue providing services, you are refunded the unused balance of any package in full.

9. Termination

Either party may end this Agreement at any time on written notice. We may terminate immediately, without refund of completed services, if you behave abusively toward us or another client, repeatedly no-show, or ignore safety instructions. Unused package sessions are refunded on termination except where terminated for the reasons just listed.

10. Limitation of liability

To the fullest extent permitted by Ohio law, our total liability arising out of or relating to these services is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in this section limits liability that cannot be limited by law.

This section is separate from, and in addition to, the Liability Waiver and Assumption of Risk you sign before your first session.

11. Media

We will not photograph, record, or use your image in any marketing without your separate written consent, which you may withdraw at any time.

12. General

Governing law. This Agreement is governed by the laws of the State of Ohio. Any dispute is subject to the exclusive jurisdiction of the state courts located in Lake County, Ohio.

Entire agreement. This Agreement, together with the Liability Waiver, the published rates, and the Privacy Policy, is the entire agreement between us.

Changes. We may update this Agreement on 30 days' notice posted at defynyourself.com/terms. Continued use after that constitutes acceptance.

Severability. If any provision is found unenforceable, the rest remains in effect.
